1. Acceptance of Terms
By accessing or using the Service — whether you sign up, claim a profile, submit a lead inquiry, browse anonymously, or simply load a page — you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. Account Eligibility
You must be at least 18 years old, located in the United States, and able to form a binding contract. You agree to provide accurate, current, and complete information when registering and to keep that information up to date.
3. Account Types
- Visitor — anyone browsing the Service. May view public buildings, neighborhoods, agents, and brokerages, and may submit lead inquiries.
- Registered User — has signed up with an email and password (or via Google). Can save preferences and receive email digests.
- Claimed Agent — a registered user who has passed Stripe Identity verification and claimed a real estate agent profile. Can edit profile content, receive routed leads, and subscribe to Pro Profile features.
- Brokerage Owner — a registered user with verified authority over a brokerage entity. Can manage the brokerage profile and (where enabled) the affiliated agents.
- Admin — internal staff with elevated access for operating the Service.
4. Subscriptions and Payments
Plans and pricing
- Pro Profile (Founding Member) — $9 / month. Limited founding-member tier offered while available.
- Pro Profile (Standard) — $19 / month. Standard agent subscription after the founding tier closes or for new signups outside the founding window.
- Broker Profile — $49 / month. Brokerage-level subscription with brokerage-management features.
- Off-Market Sale — $49 single submission / $99 bulk (one-time charges, not subscriptions). Used to submit closed off-market deals for ranking and display.
Billing and auto-renewal
Subscriptions are billed monthly through Stripe and renew automatically until you cancel. You can cancel at any time from your account dashboard or via the Stripe billing portal. Cancellation takes effect at the end of the current billing period; you will continue to have access until that period ends.
Founding-member pricing lock
If you subscribe at the founding-member price, that price remains locked for as long as your subscription is continuously active. If your subscription lapses (cancellation, failed payment without cure, or other interruption), the founding-member price is forfeited and resubscribing will be at the then-current standard price.
Refunds
We may, at our discretion, issue refunds for subscription charges within 7 days of the charge. Off-market submission fees are generally non-refundable once the submission has entered review. Email support@condointelligence.com with refund requests.
Taxes
Prices do not include applicable taxes. You are responsible for taxes assessed on your purchase.
5. Identity Verification
To claim an agent profile you must complete identity verification through Stripe Identity. We do not store the underlying ID images on our servers; Stripe processes them under their own terms and privacy practices. Failure to complete verification, or verification that does not match the agent record being claimed, will result in the claim being denied.
6. Agent Profile Rights and Responsibilities
- You may only claim a profile if you are the licensed real estate agent of record (or, for a brokerage profile, a person with lawful authority to act on behalf of that brokerage).
- You may not impersonate another agent, brokerage, person, or entity.
- You may not upload or post content that is obscene, defamatory, discriminatory, harassing, unlawful, or that infringes a third party's intellectual property or privacy rights.
- Your profile content (photo, bio, business contact details, license number, brokerage affiliation, social links, submitted sales) may be displayed publicly and indexed by search engines.
- You are responsible for keeping your contact information current and for the accuracy of any content you submit.
- We may suspend or terminate any profile, claim, or subscription that violates these Terms, with or without notice.
7. Off-Market Submission Terms
When you submit an off-market sale you represent and warrant that:
- The transaction has actually closed.
- You have the lawful authority to disclose the transaction details, and disclosure does not violate any non-disclosure obligation, listing agreement, or law.
- The information you provide is accurate to the best of your knowledge.
By submitting, you grant us the right to use the submitted data for ranking, leaderboard placement, and redacted public display. We may decline or remove submissions that we cannot verify or that we believe violate these Terms.
8. Lead Inquiries
The Service may route buyer-side inquiries to claimed agents or brokerages. Agents are solely responsible for handling, qualifying, and following up on leads they receive. We make no guarantee that any lead will respond, qualify, transact, or convert into business. We are not a party to any communication or transaction between agents and inquiry submitters.
9. Acceptable Use
You agree not to:
- Scrape, crawl, or use automated tools to collect data from the Service in bulk.
- Reverse engineer, decompile, or attempt to extract source code.
- Bypass or attempt to bypass authentication, rate limits, or other technical controls.
- Use the Service to harass, threaten, defame, or stalk any person.
- Send spam or unsolicited bulk communication using leads or contact data obtained through the Service.
- Resell, sublicense, or redistribute MLS data obtained through the Service.
- Use the Service in violation of any applicable real estate, fair housing, consumer protection, or other law.
10. Intellectual Property
The Service — including its design, code, text, graphics, logos, and branding — is owned by us or our licensors and is protected by copyright, trademark, and other laws. MLS listing and sale data is sourced from the Bridge Data API and used under that license.
By submitting content (including profile photos, bios, off-market submissions, and reviews) you grant us a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, modify (for formatting), and distribute that content on the Service and in marketing materials about the Service. You retain ownership of your content.
11. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.
Real estate market data, scores, rankings, and metrics on the Service may be incomplete, delayed, or inaccurate, and are not investment, tax, legal, or financial advice. Do not rely on the Service as the sole basis for any real estate or financial decision.
We are not a real estate brokerage, broker, agent, lender, appraiser, or escrow agent, and we are not a party to any transaction conducted as a result of the Service.
12. Limitation of Liability
To the maximum extent permitted by law, our aggregate liability for any claim arising out of or related to the Service is capped at the greater of (a) the fees you paid us in the 12 months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100). We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, or business interruption, even if advised of the possibility.
13. Indemnification
You agree to defend, indemnify, and hold harmless Condo Intelligence, LLC and its officers, directors, employees, and agents from any claim, demand, loss, liability, or expense (including reasonable attorneys' fees) arising out of (a) your use of the Service, (b) your violation of these Terms, (c) content you submit, or (d) your violation of any third-party right.
14. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the Service ends; the sections of these Terms that by their nature should survive (including ownership, disclaimers, indemnification, limitation of liability, and governing law) will survive.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law principles. Any dispute arising out of or related to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Miami-Dade County, Florida, or, at our option, by binding arbitration administered by JAMS under its Streamlined Arbitration Rules. You waive any objection to venue and personal jurisdiction in those forums.
Class-action waiver. Disputes must be brought in your individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.
16. Changes to These Terms
We may update these Terms from time to time. When we make material changes we will revise the "Last updated" date at the top of this page and, where appropriate, notify you by email or via the Service. Continued use of the Service after a change constitutes acceptance of the updated Terms.
